Terms of Service

These Terms of Service ("Terms") govern your use of Brevard Digital's website and social media management services ("Services"). By subscribing to any plan or submitting a request through our website, you agree to these Terms. Please read them carefully.

1. Services

Brevard Digital provides social media content creation, scheduling, and management services for businesses on the Space Coast of Florida. The specific deliverables (number of posts, platforms, graphics) depend on the plan you select at signup. All plan details are displayed on the Pricing page of our website at the time of purchase.

2. Payment and Billing

• Services are billed monthly in advance through Stripe, a third-party payment processor.
• By providing payment information, you authorize us to charge your payment method on a recurring monthly basis.
• All prices are in USD. Taxes, if applicable, are the responsibility of the client.
• Failed payments will result in a temporary pause of service. We will notify you by email and provide a 5-day grace period to update payment information.

3. Cancellation

• You may cancel your subscription at any time, for any reason, with no cancellation fees or penalties.
• Cancellation takes effect at the end of your current billing period. No partial-month refunds are issued.
• To cancel, email dev@brevarddigital.com at least 48 hours before your next renewal date.

4. Refunds

Given the nature of creative services, we do not offer refunds for completed work. If you are dissatisfied with your first month's content, contact us within 7 days of delivery and we will revise it at no charge or issue a one-time credit toward your next month at our discretion.

5. Client Responsibilities

To receive the best results, clients agree to:

• Complete the onboarding brand questionnaire in a timely manner.
• Grant page access through Meta Business Manager within 5 business days of signup.
• Review and respond to content calendars within 5 business days of delivery. Failure to respond is considered approval.
• Provide accurate information about their business, including any content restrictions or legal limitations specific to their industry.

6. Content Ownership

All content created by Brevard Digital on your behalf becomes your property upon payment for that billing cycle. We retain the right to use anonymized examples of our work (without revealing your business name or confidential information) in our own marketing materials, unless you request otherwise in writing.

7. Account Access

Clients grant Brevard Digital limited access to their Facebook and Instagram accounts for the purpose of scheduling and publishing approved content. This access is granted through Meta's official Business Manager API. Clients may revoke this access at any time through their Facebook settings, which will pause service until access is restored.

We will never request your personal login password. If anyone claiming to represent Brevard Digital asks for your password, do not provide it and contact us immediately.

8. Acceptable Use

You agree not to use our Services to post content that is illegal, defamatory, discriminatory, or in violation of Meta's Community Standards or any applicable law. We reserve the right to decline to publish content that we reasonably believe violates these standards. You remain solely responsible for the content published on your business pages.

9. Limitation of Liability

Brevard Digital's total liability for any claim arising from these Terms or the Services shall not exceed the total amount paid by you in the 30 days preceding the claim. We are not liable for indirect, incidental, or consequential damages of any kind, including lost revenue, loss of followers, or algorithm changes by third-party platforms.

Social media platform algorithms and reach are outside our control. We make no guarantees regarding follower growth, engagement rates, or business revenue resulting from our services.

10. Termination by Brevard Digital

We reserve the right to terminate service immediately, without refund, if a client engages in abusive behavior toward our team, requests content that violates our Acceptable Use policy, or materially breaches these Terms.

11. Changes to These Terms

We may update these Terms at any time. Active clients will be notified by email at least 14 days before changes take effect. Continued use of the Services after that date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions. Any disputes shall be resolved in Brevard County, Florida.
